The Cookie Maker Inc., a Berkeley-based cookie maker using a teardrop shaped chocolate chip design on its packaging, has filed a preemptive lawsuit against Hershey Co. in San Francisco federal court seeking an order that it has not infringed Hershey’s intellectual property rights protecting the shape of its well-known Hershey’s Kisses.
